Terms of Service

Please read these terms carefully before using NivaasCloud. They define your rights and responsibilities as a user of our platform.

Acceptance of Terms

  • By accessing or using NivaasCloud, you agree to be bound by these Terms of Service and our Privacy Policy.
  • If you are using NivaasCloud on behalf of a business, you represent that you have authority to bind that business to these terms.
  • We may update these Terms at any time. Continued use after updates constitutes acceptance.

Use of Service

  • NivaasCloud is a cloud-based hotel management platform (hotel PMS). You may use it solely for lawful business purposes.
  • You must not attempt to reverse-engineer, decompile, or extract the source code of our platform.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must not use the platform to process fraudulent transactions, spam customers, or violate any applicable law.
  • We reserve the right to suspend accounts that violate these terms without prior notice.

Subscriptions & Payments

  • NivaasCloud is offered on a subscription basis. Plans and pricing are listed on our Pricing page.
  • Subscriptions auto-renew at the end of each billing cycle unless cancelled at least 24 hours before renewal.
  • Any applicable taxes or statutory charges on a transaction are handled in accordance with applicable law.
  • Payments are processed via Razorpay. By subscribing, you authorise us to charge your payment method.
  • Downgrades take effect at the end of the current billing cycle; upgrades are prorated and take effect immediately.

Intellectual Property

  • All software, design, trademarks, and content on NivaasCloud are owned by SinghCode Technologies.
  • Your hotel data (rooms, reservations, guest records, folios) remains yours. We claim no ownership over it.
  • You grant us a limited licence to store and process your data solely to provide the service.
  • On account termination, your data is retained for 30 days before permanent deletion, unless a longer period is required by law.

Disclaimer of Warranties

  • NivaasCloud is provided "as is" and "as available" without warranty of any kind.
  • We do not warrant that the service will be uninterrupted, error-free, or free of viruses.
  • We are not responsible for losses caused by hardware failure, connectivity issues, or third-party integrations outside our control.

Limitation of Liability

  • To the maximum extent permitted by applicable law, SinghCode Technologies shall not be liable for any indirect, incidental, special, or consequential damages.
  • Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 3 months prior to the event giving rise to the claim.

Termination

  • You may cancel your subscription at any time from the billing settings in your dashboard.
  • We may terminate your account immediately if you breach these Terms, engage in fraudulent activity, or upon 30 days written notice for any other reason.
  • Upon termination, your right to use the service ceases immediately.

Governing Law

  • These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mohali, India.
  • Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation for at least 30 days.
